Supreme Court Declines Case

This was an interesting article that raises the question of a statute of limitations. Should there be some statute of limitations on murder? And should it matter in a case with this type of racial prejudice?

The use of DNA evidence probably makes these kinds of cases easier to prove. And I don't believe there should be a statute of limitations on murder, but I do wonder whether a fair trial can be had after so much time has passed.

I agree - no statute of limitations on murder. It would be a gross miscarriage of justice if they found evidence of a murderer 30 years later who couldn't prosecuted. As far as a fair trial, it might be even more unfair to the victims than the defendants. It will be much harder to prove beyond a reasonable doubt after so much time. So if they can make the case, then more power to them. Racial prejudice should probably be neither here nor there - dead is dead, murder is murder. I do understand the "crime against the community" mentality of hate crime legislation, but when you get to the point of murder, I feel like it should be the same justice for all.

I agree, Megan. Racial prejudice has nothing to do w/ DNA evidence. DNA does not discriminate, juries, lawyers, judges, all may.

That aside, murder does not and should not have a statute of limitations. It might be harder to prove causation after 30 years, but that should not stop justice from being properly served, if possible.


At the end of the day this is a problem for the antiquated justice system to deal w/, not journalists, unless of course there's a method to their madness.

A murder's a murder a murder. I don't see how this is really even an issue - you can't just let the slaying of two teenager slide.

They're still prosecuting Nazi war criminals who were in the S.S. and Gestapo, and it's been almost seventy years since they committed their crimes. I'm pretty sure that the Nazis got far, far more press than James Seale. If you're suspected of or known to have committed a murder, then some sort of ruling needs to be made on behalf of your actions, regardless of time passed since the crime. Period.

I also agree there should be no statue of limitations on murder.If evidence presents itself  at any time ,incriminating someone to a murder, they should be brought to trial, and taken off the streets.

If somebody has a criminal mind it is very likely they will preform a criminal act again.So if we can prove they committed a crime they should be accountable for it , no matter how much time has passed.It's not about any racial prejudice it's about justice.
